The website chapitresixhotels.com (hereinafter the “Site”) brings together the hotels of the Chapitre Six collection. Each hotel is operated by a separate company, identified on its own legal notice page (see article 9).

The Site presents the Chapitre Six collection and allows users to view the establishments’ offers and access their booking process. Information on availability, rates and conditions of stay is provided by the company operating the establishment concerned, which remains responsible for its accuracy and for keeping it up to date.

3. Intellectual property

The site, its structure and all of its content — including texts, software, databases, photographs, illustrations, videos, sounds, graphic elements, logos, trademarks, domain names and layouts — are protected by the French Intellectual Property Code. They belong to Chapitre Six or to its partners and rights holders.

Unless prior written authorisation has been obtained from the rights holder, any reproduction, representation, adaptation, modification, extraction or exploitation, in whole or in part, is prohibited, except for strictly personal, private and non-commercial use within the limits provided for by law. Any unauthorised use may constitute an infringement punishable in particular under Articles L. 335-2 et seq. of the French Intellectual Property Code.

In accordance with Articles L. 341-1 et seq. of the same Code, it is also prohibited, without prior written authorisation:

To extract or reuse a substantial part of a database accessible on the site,
To repeatedly and systematically extract or reuse non-substantial parts of its content where such operations exceed the normal conditions of use of the site.

4. Liability and access to the site

Chapitre Six endeavours to ensure that the information published on the Site is accurate and up to date, but cannot guarantee that it is complete, error-free or permanently available.

The Site is in principle accessible 24 hours a day, 7 days a week, subject to maintenance operations, outages, technical constraints and events beyond the reasonable control of Chapitre Six.

Subject to mandatory legal provisions, Chapitre Six shall not be held liable for damage resulting from temporary unavailability, inappropriate use of the site or a fraudulent intrusion leading to an alteration of the published information. Users remain responsible for their equipment, their connection and the use they make of the information available on the Site.

Chapitre Six accepts no liability for damage resulting from a fraudulent intrusion by a third party leading to a modification of the published information.

The Site may contain links to third-party sites over which Chapitre Six has no control and for which it cannot be held responsible. Creating links to the Site is subject to the prior written consent of Chapitre Six.

8. Bookings and terms of sale

Bookings made via the Site are entered into directly with the company operating the chosen hotel, which is the seller. Chapitre Six, as holding company and publisher of the Site, is neither the seller nor the provider of the accommodation service, unless expressly stated otherwise.

The applicable general terms and conditions of sale are those of the establishment concerned, accessible in the footer of each hotel Site. They set out in particular the booking and payment terms, cancellation conditions, complaint procedures and recourse to the consumer mediator, as well as the rules applicable to marketing communications. They are brought to the client’s attention during the booking process and are accessible from the footer of the Site.

10. Changes to the legal notice

Chapitre Six may amend this legal notice to reflect changes to the site, its services or the applicable regulations. The applicable version is the one published online on the date the site is consulted, without prejudice to the general terms and conditions of sale accepted by the client when booking.

11. Governing law

This legal notice is governed by French law. Any dispute relating to its interpretation or to the use of the Site falls within the jurisdiction of the competent courts.
